YOUR CONTINUED USE OF THE WEBSITE CONSTITUTES YOUR AGREEMENT TO ANY NEW OR MODIFIED PROVISION OF THIS AGREEMENT THAT MAY BE POSTED ON THE WEBSITE.
PAINLESS NUTRITIONALS LLC IS NOT A COVERED ENTITY FOR PURPOSES OF THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 (“HIPAA”), NOR IS THE INFORMATION PROVIDED BY YOU TO US CONSIDERED PROTECTED HEALTH INFORMATION UNDER HIPAA. AS SUCH, THE ADDITIONAL PRIVACY AND SECURITY PROTECTIONS AFFORDED TO CONSUMERS/PATIENTS UNDER HIPAA ARE NOT CONTEMPLATED BY, NOR CONTAINED WITHIN, THE AGREEMENT.

This Agreement constitutes the entire and only agreement between you and Company with respect to your use of the Website and supersedes all prior or contemporaneous agreements, representations, warranties and/or understandings with respect to your use of the Website, the content contained therein and/or the analyses, research, opinions, and other information provided by or through the Website. Company may change the Agreement, in whole or in part, at any time without specific notice to you. The latest Agreement will be posted on the Website. Your continued use of the Website following posted notice, constitutes your acceptance of all of the Terms and Conditions contained within the Agreement in effect at that time. Therefore, you should regularly check this page for updates and/or changes. Unless explicitly stated otherwise, any future offer(s) or product(s) made available to you on the Website that augment(s) or otherwise enhance(s) the current features of the Website shall be subject to the Agreement posted at the time of your purchase. Company is not responsible or liable in any manner whatsoever for your inability to use the Website and/or obtain any online products. The Website and products offered are available only to individuals who are at least eighteen (18) years of age and can enter into legally binding contracts. Company reserves the right, in its sole discretion, to deny any order of anyone at any time and for any reason, whatsoever. You certify that you are eighteen (18) years of age and agree to provide true, accurate, current, and complete information when prompted for such information.
In consideration for the products you order from Company, you agree to pay the sums listed in the payment box at the time such sums are due and owing. You shall have the choice to pay with a credit card or debit card. Company’s authorization to provide and bill you is obtained by way of your electronic signature. Once an electronic signature is submitted, this electronic order constitutes an electronic letter of agency. Company’s reliance upon your electronic signature is specifically sanctioned by the Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Transactions Act. Both laws specifically preempt all state laws that recognize only paper and handwritten signatures.
Note, we do not ship orders to these countries: Cote d'lvoire, Democratic Republic of the Congo, Liberia, Lebanon, Sudan, Belarus, Iraq, Zimbabwe, Syria, Cuba, Iran, North Korea, Sierra Leone, Palestinian Territories, South Sudan, Myanmar, Ghana, Kyrgyzstan, Kazakhstan, Nigeria, Malaysia, Indonesia, Guadeloupe, Botswana, Netherlands Antilles, India and Barbados.
2.3. Return and Refund Policy. We Guarantee one hundred percent (100%) satisfaction or your money back. If at any time you are unsatisfied with our product, you may return any unopened bottles of any shipment within sixty (60) days of our shipping date for a full refund of the purchase price.
To receive a refund, you must follow the following procedures:
- Call our Customer Service Center at (888) 947-3780 or send an email to support@PainlessNutritionals.com and request a Return Materials Authorization (RMA #) label. This will ensure that our warehouse can quickly add it back to our inventory. If you request a return label by email, you will receive a response via email with your return label.
- Place the RMA label you receive clearly on the outside of the returned package to expedite processing, clearly write your order ID number on the outside of the package. Our return department is not allowed to process packages without a RMA, and no refunds will be issued for any packages returned without a RMA, including packages marked as “Return to Sender.” Send the package to Returns Department:

- You must send all the unopened products within (7) days from the time the RMA label was issued. We will pay for the shipping of the unopened bottles. Please note that the RMA label will expire in 7 days. Your merchandise must be received by our returns department within 7 days from the time the RMA label was issued.
We encourage you to email us at support@PainlessNutritionals.com when your returned merchandise is in the mail so we can track the package.
- Refunds will be issued only to the same credit card that was used in ordering the product. It generally takes about 7 to 14 business days to receive a refund. We will process the refund as soon as the warehouse receives the package and confirms that the items are received in good condition. Refunds will be for the cost of the product. Shipping and handling is not refundable.
3. DISCLAIMER OF WARRANTIES.

4. LIMITATION OF LIABILITY.

Should any part of the Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. The Agreement is personal between you and us and governs your use of our Website and the purchase of our products. Our failure to enforce any provision of the Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. The parties do not intend that any agency or partnership relationship be created through operation of the Agreement. You may not assign any of your rights under these Terms and Conditions, and any such attempt will be void.
